The Building and the Permission Are Separate
A school or childcare property is worth what it is because it may lawfully be used for that purpose, and the permission to do so is held by the operator rather than attached to the land.
A state license names a specific operator and a specific location, with a capacity set by square footage, outdoor area and egress. It does not transfer with a deed. A buyer applies in their own name, approval takes time, and the period between closing and licensing is a period with a building and no operation.
That gap is the central underwriting fact in these transactions, and nothing in the land record addresses it.
What the Land Record Does Govern
Three things, and the first of them stops more deals than zoning does.
- Restrictive covenants. A parcel limited to residential use by a declaration, an association rule barring commercial activity, or a condition imposed by a prior owner on sale can forbid the use outright. A covenant prohibits what zoning permits, and between the parties bound by it the covenant governs.
- Easements serving the site. Outdoor play area is a licensing requirement expressed in square feet, and on a constrained parcel it is frequently satisfied by land the operator does not own. Drop-off lanes and parking are often shared under recorded agreements, or under nothing at all.
- Reverter and use conditions. Land donated or sold cheaply for educational use sometimes came with a condition returning it to the grantor's successors if that use ceases. On older parochial and community school parcels these are genuinely common.
The reverter is the one worth searching specifically for, because it sits at the root of the chain rather than near the top. A current owner search will not reach it, and the analysis is the same as on church and nonprofit property.
What Sits With the Agencies
The license, its capacity and its conditions. Inspection and violation history. Zoning determinations and any special use permit, which on a school is frequently conditional and carries obligations about traffic, hours and enrollment. Fire marshal approvals for the use rather than for an office.
Also outside the record is whether the building meets current accessibility and safety standards for the use, which on an older structure converted to a school can be a substantial capital item.
A clean title search establishes that the land is conveyable. It establishes nothing about whether a school may operate in the building standing on it.
Institutional Owners Add a Layer
A great many school properties are held by entities that cannot simply sell.
A nonprofit corporation acts through its board and may need a resolution naming the transaction. A religious body may require approval from a diocese, conference or synod. A charitable trust may need notice to or approval from the state attorney general before disposing of significant assets. And older parcels sometimes name individual trustees who died decades ago, with no successor instrument ever recorded.
None of that is usually in the land record, which establishes who holds title while the authority to convey sits in corporate and denominational documents. Both have to line up before a closing can happen.
Ordering the Search
Give us the address, the county, every parcel number, and every name the property may be held under, including the operating entity, any holding or parent organization, prior names after a merger, and trustee names from any old deed you have. Say whether the play area or parking crosses an adjoining parcel.
A full chain of title search is the right scope rather than a current owner search, since reverters and use conditions sit deep in the chain. A judgment and lien search against every entity name belongs with it.
A title search reports what was recorded and found in the indexes reviewed, as of the day the work was done. It does not report licensing, capacity, zoning compliance or inspection history. See all search products, or tell us the entity names and the county and we will scope it before anything is ordered.
